Use this form to start a minor debt dispute at the Queensland Civil and Administrative Tribunal (QCAT) to recover a fixed or agreed amount of money owed to you, up to $25,000.

To complete this form you will need to provide:

  • the full name of the respondent(s)
  • the correct address of the respondent(s)
  • details of the debt and supporting documents, including a copy of the agreement.

  1. Can I apply?
    1. Is the debt or amount owing being claimed less than $25,000 (excluding interest)? *

      We can only resolve minor debt claims up to the amount of $25,000.

      If the amount owing is more than $25,000, you may choose to reduce your claim so you can lodge it with us, or you can lodge it at another court.

      You may need to get independent legal advice on where to commence proceedings.

      If there was no agreement, you are unable to lodge a minor debt application.

      Agreements may be in writing, or through a verbal agreement. Agreements can include:

      • loans not repaid
      • IOUs
      • an unpaid invoice, account or demand
      • dishonoured cheques
      • work done and/or goods supplied with the cost having been agreed beforehand
      • the removal of minor overhanging branches
      • unpaid rental or hire fees (except for residential tenancy matters).

      If you are unsure whether you have an agreement, you may need to get independent legal advice.

      Brisbane

      If you selected Brisbane as your nominated location, you do not need to print your application and lodge at QCAT. After you have paid, your application will be submitted electronically to QCAT and you will receive a sealed copy returned to your email. Please note, this may not be returned immediately and can take up to 2 hours.

      Outside of Brisbane

      For all other locations after you complete your payment and receive an emailed copy of the application form, you must print it and lodge it at the QCAT location you have nominated.

      You can lodge it in person or by post the nominated Magistrates Court.

      When lodging by post or in person you must lodge:

      • your original application and copies of any attached documents
      • an extra copy of the application and attached documents each for
        • yourself
        • the respondent
        • each additional respondent.

      You must lodge your application at the location you have specified when completing the application form.

      As you selected Brisbane as your nominated location, you do not need to print your application and lodge at QCAT. After you have paid, your application will be submitted electronically to QCAT and you will receive a sealed copy returned to your email. Please note, this may not be returned immediately and can take up to 2 hours.
