In accordance with s122(2) of the Queensland Civil and Administrative Tribunal Act 2009 (QCAT Act), a party to a proceeding may, within 14 days after the Tribunal’s decision takes effect, request reasons for the decision. The decision generally takes effect on the day it is made, unless otherwise stated in the decision.
If you are lodging a request for reasons outside the 14-day time limit you must provide the reason you are requesting an extension of time which will be considered by QCAT on a case-by-case basis.
QCAT has 45 days after your request is made to provide the reasons unless the President of QCAT extends the time.
QCAT does not have to give reasons for some procedural decisions made in the proceedings (see section 122(4) QCAT Act).
Where the decision or reasons have been given orally by the Tribunal, section 123(2) QCAT Act provides that it is enough for the Tribunal to give the person a written transcript, or an audio recording, of the part of the proceeding in which the decision or the reasons are given.
If reasons were not provided orally by the Tribunal, the request for reasons will be provided to the QCAT decision-maker so they can prepare written reasons for the decision.
Please note that ALL requests for reasons must be made through the QTranscripts online platform and this product type in QTranscripts does not incur a fee.
To access QTranscripts services online a person must prove who they are by establishing a digital identity through myID or QGov.
A person must use their myID or QGov digital identity to make an online QTranscripts request.
Follow these steps to access QTranscripts:
- Go to qtranscripts.justice.qld.gov.au
- Click on the Log In icon.
- On selecting Log In to QTranscripts, you be given the option to login using myID or QGov.
- If you do not have a myID or QGov identity, you will be prompted to create one.
- Once you enter your details and log in to either myID or QGov you will be redirected back to QTranscripts as logged in.
