Request reasons for a decision

If you are a party in the proceeding, representing a party in the proceeding or an interested party to a proceeding, you may request the reasons for a decision.

The Tribunal is not required to give written reasons for some procedural decisions set out in s122(4) of the QCAT Act.

There is no fee to request reasons.


Time frame for requesting written reasons

You should request the reasons within 14 days after the decision takes effect.

If you make a request outside the 14-day period, you must provide an explanation as to why the request was made out of time. The request may be refused.


How Reasons Are Provided

If the Tribunal gave its reasons orally, you may be provided with a transcript of the part of the proceeding where the decision and reasons were given at no cost.

If no reasons were given for the decision, your request will be sent to the Tribunal to be considered.

The Tribunal has 45 days to provide reasons after your request has been accepted, unless the President of QCAT exttends this time.


Reasons and Appeal Timeframes

The time limit for filing an appeal may be affected by whether you have requested the reasons for the decision. Please see Appealing a QCAT Decision for more information or s122 and s143(4) and (5) of the QCAT Act.


How to Submit a Request for Reasons

All requests for written reasons must be submitted using the QCAT Reasons Request form.

Request reasons for a decision

You must submit the form by email to EnquiriesQCAT@justice.qld.gov.au, or in person at a QCAT Registry.

Receiving you Reasons

Either written reason or a transcript of the oral reasons will be provided to you in due course.

If you are receiving written reasons, these will be sent to you by QCAT staff.

If you are receiving oral reasons by transcript, these reasons will be provided via the QTranscripts portal.

When you visit QTranscripts for the first time, it will ask you to login with your Digital ID account where you will need to prove your ‘digital identity’. Find out about the Digital ID requirements on the Digital ID FAQ page.
