The tribunal's power of arrest and the issuing of warrants

In contempt applications, the tribunal will generally not use its power of arrest to ensure that the accused attends the tribunal unless it appears that the respondent may not otherwise appear.

Penalties in contempt proceedings

If the tribunal decides that the respondent has committed a contempt, the tribunal may make an order under the Penalties and Sentences Act 1992 for an individual, for example a fine.

If the respondent is a corporation, the tribunal may penalise them by seizing corporation property, instituting a fine, or both.

Right of appeal

Only a judicial member may exercise the tribunal’s jurisdiction for contempt.  A person found guilty of contempt by the tribunal may appeal to the Court of Appeal.
