1. Before you make a referral to QCAT
QCAT considers privacy complaints on referral from the Information Commissioner regarding breaches of information privacy under the Information Privacy Act 2009 (Qld) (IP Act).
Before a referral is made, you must provide the relevant information related to the complaint to QCAT in the relevant forms below. You may also attach additional information in an attachment and file the attachment with this application.
2. Complete and lodge an application
To make a referral complete and lodge the form below. Carefully read the form instructions, answer each question, and tick an appropriate box when prompted.
There is no prescribed fee for making a referral.
Form 35 - Referral of a matter (non disciplinary)
The purpose of this form is to refer a matter to QCAT.
3. How to lodge your referral
When filing a referral, you are required to file the referral and supporting material along with three copies in one of the following ways:

4. Giving the referral to the parties
Once the referral has been received, QCAT will organise for a copy of the referral and attached documents to be provided to the parties to the dispute. The file will then be provided to a QCAT-decision maker for further consideration.
