1. Before you make a referral
QCAT considers discrimination complaints on referral from the Queensland Human Rights Commission (Commission).
QCAT can also provide opinions on anti-discrimination matters to the Commissioner.
Before you apply, you must complete the relevant forms below. You may also attach additional information in an attachment and file the attachment with the referral.
Only the Commission can refer a discrimination complaint to QCAT. A complainant cannot refer a discrimination complaint.
2. Complete and lodge this form
To make a referral complete and lodge the form below. Carefully read the form instructions, answer each question, and tick an appropriate box when prompted.
There is no prescribed fee for referral of a discrimination complaint.
Form 35 - Referral of a matter (non disciplinary)
The purpose of this form is to refer a matter to QCAT.
3. How to lodge your application
When filing a referral, you are required to file the referral and supporting material along with three copies (excluding online referrals) in one of the following ways:

4. Giving your application to the other parties
Once the referral has been received, QCAT will organise for a copy of the referral and attached documents to be provided to the parties of the complaint. The file will then be provided to a QCAT decision-maker for further consideration.
