1. Before you apply to QCAT

Health Practitioners are governed by the Office of the Health Ombudsman (OHO) and the Australian Health Practitioner Regulation Agency (AHPRA).

The OHO is the first place to contact for all health service complaints in Queensland. AHPRA assists by working with 15 National Health Practitioner Boards (Board) who register practitioners and students.

If you disagree with a decision, QCAT can review various decisions in the regulation of health practitioners, students and other health providers. Reviewable decisions include:

(For full list of reviewable decisions please view the Health Practitioner Regulation National Law (Queensland) and Health Ombudsman Act 2013)

Before you apply to review a decision, you must ensure the relevant decision letter or information notice issued to you is included with your application forms. The letter sets out the decision made by the relevant authority and your review rights.

2. If your review application is urgent

If an interim prohibition order or immediate registration action decision has been made against you and you believe the case is urgent, you can apply to QCAT to review the decision. QCAT will assess the application for urgency and refer your application to a QCAT decision maker urgently if appropriate to do so.

If you wish to request a stay of decision, the Health Ombudsman Act 2013 outlines that QCAT may not stay prohibition orders or immediate action decisions during the review process. If you make an application to stay a prohibition order or decision to take immediate action it will be dismissed by QCAT.
