1. Before you apply to QCAT

If the landlord and tenant cannot agree on the current market rent at the time of the rent’s annual review, QCAT can appoint a specialist retail valuer.

Before you apply, the parties (landlord and tenant) should complete and sign the form as attached below. Each party should include details of the names of specialist retail valuers that they have previously engaged or otherwise consulted so QCAT does not appoint one of these valuers.

This is important as QCAT must appoint a specialist retail valuer who is independent of the interests of the landlord and the tenant.

QCAT’s Civil, Administrative and Disciplinary Division Registrar will nominate a specialist retail valuer from the Valuers Registration Board of Queensland and advise the parties in writing.


2. Complete and lodge this form

To request the appointment of a specialist retail valuer, complete and lodge the form from the list below. Carefully read the form instructions, answer each question, and tick an appropriate box when prompted. Both parties must sign the application.

There is no prescribed fee to make this request.

3. How to lodge your request

When filing your request, you are required to file the request along with three copies in one of the following ways:

Your request is not filed until it is sealed by QCAT (i.e. stamp it with the official QCAT stamp). After this has been done, sealed copies of your request will then be sent back to you to give to the other party. You can also keep a copy for your personal records.


4. Giving your application to the other parties

You are required to give a sealed copy of your request to the relevant party named in the specialist retail valuer request form within seven days of receiving the request or as otherwise directed by QCAT.

5. What happens next?

QCAT’s Civil, Administrative and Disciplinary Division Registrar will nominate a specialist retail valuer from the Valuers Registration Board of Queensland and advise the parties in writing once the valuer has agreed to undertake the valuation. The parties will then be required to contact the valuer to organise the next steps in the valuation process.
